wait who needs to change their avatar? why? that sort of thing belongs in a pm I would think just so that we get it and I think my avatar is just fine. Sorry about the gay thing I was just trying to keep up with the south park theme and they are true to the first amendment in their usage of language. Yeah phyto the post wasn't angry at all just some fun. Eric hates Family Guy and so I had to take my opportunity to bash on family guy a little when it got brought up in a south park thread.

Are you a fan of south park Z?

These forums aren't under the jurisdiction of the US government, I think. This would be interesting to delve into, who has ultimate legal controll of the forums. While the moderators say they have authority, there has to be a higher entity. I would compare it to a business in the United States, they can say all they want that they have complete controll of every aspect of the organization, however the United States government has the final say.

I post this knowing that the moderation is fair, and that this post won't be taken as a 'power threat'.

edit: it's probably findable on phpbb's disclaimer

as far as websites go, i believe they fall under the jurisdiction of where the physical server is located. (please inform me if i am wrong)

FYI, my name, mkay1 is purely coincidental to south park. It was derived from Mk1, which is a long story itself.

Nsh22: what if the site was run from servers in America, and Germany?

You guys obviously don't understand the First Amendment. It forbids the government from infringing on public speech. It does not protect you from a private entity moderating your speech. Read up. Indeed, all 10 Amendments of the Bill of Rights are negative rights. They don't grant you rights (as I just pointed out in the footnote here); they prohibit the Federal government from abridging your natural rights. Ugh. This is why we need civics classes (and why NCLB has left behind an entire generation).

To this:

What a pile of baloney. Simply because you have the right to do something doesn't mean you should, and flinging around the term "gay" in a pejorative fashion sure as hell isn't some kind of noble political demonstration. There's an old term we don't hear about much anymore called forbearance. Something you, especially, could learn a thing or two about.

Slov (thanks, Slov!), not you. Yours is perfectly fine.

Not really. I liked it at first and even own the 'Chef Aid' album, but the show has only three jokes: little kids swearing like sailors, being disrespectful to everything, and killing off half the population every other episode. And they often rely on recent events relevant to the US, and by the time you can get the episodes legally here, those are rarely even remotely relevant. That said, I haven't really seen any full episodes from beyond season four or so, and I'm open to the idea they may have changed things up a bit.

And of course, we mods/forum owners are not above the law. If I were to, say, insult Word, he could sue me for it under German law, no matter where the forums are hosted. We obviously can't just post child porn and claim it's our right because it's our forum, too. But as Phytotron says, free speech laws do not apply to us. We can delete and modify the content here as much as we see fit (unless the changes turn it into something unlawful, obviously), and we're even required to do so (again, under German law, which at least applies to me whenever other Germans are involved, server location does not matter): if unlawful content is posted and brought to my attention, I have to delete it. Of course, really unlawful content is a rare sight.
