Ah, see, there's the rub. He might be violating a contract, but that's not illegal. Contracts just assign liability when an agreement is broken. He might be breaking rules at the company, but that's not illegal either. See, illegal means "against the law", as in "some cop will come and arrest you if you do it". There is some illegal that only gets a citation, from a cop. But always from a cop.
It's not illegal to run stop signs in parking lots unless the sign leads to the street. That doesn't mean the company can't fine you and refuse to serve you until you pay the fine. It is, however, dumb, unless you're totally aware you're not going to hit somebody.
It's also not illegal to take the company car down to the store to buy a pack of smokes. You might get fired for it, even if you put gas in it while you're there, but it's not illegal.
It's also not illegal to use the company's pen and paper to write your wife a love letter. I know I've done it before (written your wife a love letter), but it's not illegal. You might get fired for it, you might get some other sort of reprimand, but it's not illegal.
And as to "make it so they can't delete it", that's just more of his 10 PRINT "Hello, World!" I'm a programmer mentality. He doesn't know what he's talking about.
